Before anyone can touch a house, a plot of land or a bank account left in Albania, the heirs usually need a certificate of heirship, the dëshmi trashëgimie. It states who inherits and in what shares, and it is drawn up before the competent authority once the family relationships are proven with the right certificates. Until that document exists, most steps are simply blocked, so it is normally where we begin. Getting the certificate of heirship right also sets the ground for everything after it, from the cadastre to the bank, so we take the time to name every heir correctly.
The property side has its own tangles. A deed can be decades old, drawn up under rules that have since changed, or the title may never have been registered in the cadastre under the current owner. We check what the property records actually say, sort out what is missing, and see the property entered in the heirs’ names, so that later it can be sold or passed on without an old gap resurfacing to stop things. Where a plot has been split or built on over the years, sorting the records in advance saves a buyer or a co-heir a nasty surprise down the line.
A cross-border estate adds another layer. When the person who passed away was living in Italy while the property sits in Albania, the two legal systems meet, and EU succession rules can shape which law governs the estate and how it is recognised across the Italy–Albania border. We take that into account from the start, handle the heirship and the property on the Albanian side, and coordinate on the Italian part so the pieces are not left treated in isolation.
Much of this runs from a distance. With a power of attorney we can attend the offices for you, from the study on the SH1 in Mamurras, and you travel only for the acts that genuinely require your presence in person.
